About this Contract
barbecue-online.co.uk is a web service designed to allow you to purchase BBQ Appliances and associated products.

Interpretation
"Calor" means Calor Gas Limited
"Buyer" means the person whose order for the Goods is accepted by Us
"Contract" means the contract between the Buyer and Calor
"Goods" means Cylinder Gas and/or Appliances
"Worldpay" means the Credit Broker

Third Parties
All orders for Appliances are placed with Southampton Calor Gas Centre Ltd. All orders for Cylinder Gas are placed with Calor Gas Limited and the Calor Gas Direct Network, distributors appointed by Calor Gas.

Price of Goods
All prices displayed are Retail Prices and are inclusive of VAT at the appropriate rate.

Risk and Property
Risk of damage to the Goods shall pass to the Buyer at the time of delivery or, if the Buyer fails to take delivery of the Goods or fails to ensure that suitable access is available for the purposes of delivery of the Goods, the time when Calor has tendered delivery of the Goods from which point Calor shall bear no further responsibility for them.

Termination
Calor may end this Contract by notice to the Buyer in writing (such notice to have immediate effect), without affecting any other rights which it may have if: -

(i) except in the case of a genuine dispute, the Buyer has failed to pay any amount which the Buyer owes Calor under this Contract; or

(ii) the buyer commits any material breach of the terms and conditions of this Contract.

Liability
Except in respect of personal injury or death caused by Calor's negligence and subject to clause 13.2, Calor shall not be liable to the Buyer by reason of any representations, or implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any consequential loss or damage, cost, expenses or other claims for consequential compensation whatsoever which arise out of or in connection with the supply of Goods or their use by the Buyer except as expressly provided in this Contract.

If direct loss to property is caused as a result of the Goods being defective or as a result of Calor's negligence then in respect of proven loss Calor's liability shall be limited to a maximum of £10,000 (ten thousand pounds) in any claim or series of claims.

Where you are contracting as a consumer, no provision of these terms will affect your statutory rights.

General
The Contract and the construction, validity and performance thereof shall be governed by the laws of England and the parties hereby submit to the non-exclusive jurisdiction of the English Courts in respect of any dispute, suit or proceedings which may arise out of or in connection with the Contract.

There are four ways of ordering:

Secure On Line Credit Card Transactions
Using our on line shopping basket you can browse the site and collect items as you go. Items that are placed in the shopping basket can be reviewed and deleted at any time throughout your visit.

When you have completed selecting your purchases proceed to check out where you will be prompted for your personal details and method of payment. Delivery charges will be clearly marked on the page and added to your order. If you do not agree with the delivery charges you can cancel your order at this stage. When the order is processed it will be encrypted using the industry Standard Protocols and processed by Worldpay. Information on this can be found at www.worldpay.com.

If your browser is configures to accept cookies then details of your visits to our site will be stored as a cookie so that we can monitor customer usage of the site.

These charges will be displayed clearly and added to the order at the check out stage.

For addresses within the UK, our aim is to deliver your goods within 5 working days from the receipt of your order, however, you can normally expect delivery to be made next working day. If we cannot deliver your order within 5 working days, we will contact you by either telephone or email to arrange a delivery date. We may contact you to confirm delivery of high value or fragile items.

Please Note: You will be contacted the day before delivery. If no one is available to sign for your order on the day, a card will be left notifying you of the attempt to deliver and giving you directions for collection. Alternatively, please leave another delivery address.

Appliances:
For Appliance deliveries outside Mainland Great Britain e-mail your requirements to charles@socal.co.uk and we will calculate the cost of carriage.

If the Buyer fails to take delivery of the Goods or fails to ensure that suitable access is available for the purpose of delivery of the Goods then without prejudice to any other right or remedy available to Calor, Calor may cancel the Contract or suspend any further deliveries to the Buyer and may:-

Store the Goods until actual delivery and charge the Buyer for reasonable costs of storage; or
Sell the Goods at the best price readily obtainable.

It is the responsibility of the Buyer to arrange inspection of the Goods immediately on delivery.

 

Tax Charges

For orders made from the UK or the European Union, 17.5% VAT is added.

 

Credit Card Security

Calor use Worldpay Secure Payment Gateway to protect your credit card information and ensure your security. We do not see your credit card information.

 

Guarantee

We offer a full 12 months guarantee on all products which is supplemented in some cases by an longer manufacturers guarantee.

Complaints Handling Procedure
All comments will be treated in the strictest confidence in line with our published privacy policy

Queries are segmented by product type, gas cylinder and appliance. This allows Calor to track the nature of enquiry for each product range and improve our service where it is required.

On receiving a customer telephone call or email the customer receives an automatic e mail response to acknowledge receipt of their e mail or agent response to their call.

Appliance and Gas Cylinder queries receive a response within 48 hours. The response will include an estimate on date and action required to resolve the query.

All calls are logged onto Calor's Talent software to register all details of the query including the agent responsible for resolution, nature of query, date received and resolved. This system allows Calor to run reports on the status of a particular query.

Privacy Policy

Southampton Calor Gas Centre Ltd do not disclose buyers' information to third parties. Cookies are used on this shopping site to keep track of the contents of your shopping cart once you have selected an item, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option.

To the extent that any data supplied by the Buyer to Calor whilst using the site is personal data (as defined in s.1(1) of the Data Protection Act 1998), it will not be used by Calor without the Buyer's consent. The Buyer consents to Calor using the Buyer's personal data to administer and keep records of the Buyer's orders and also to provide the buyer with details of products or services Calor or its associated companies consider might interest the Buyer. Calor will not pass the Buyer's personal information to any third party for marketing or promotional purposes.
Data collected by this site is used to:
a. Take and fulfill customer orders
b. Administer and enhance the site and service
c. Only disclose information to third-parties for goods delivery purposes

 

Returns Policy

If you are contracting as a consumer you are entitled to cancel this Contract and receive a full refund for any reason at any time in the seven working days after the Goods are delivered to you. During that period you should take reasonable care of the Goods including storing them in dry conditions and refraining from using them. In order to cancel Appliance orders you must telephone us on 02380 788155 or E-mail charles@socal.co.uk; to cancel Gas orders you must telephone us on 01926 626 626. All cancellation requests must be made within the period of seven working days mentioned above and appliances should be returned to Southampton Calor Gas Centre Ltd. at the cost of the purchaser.

Refunds
In the unusual event that we deliver a faulty or incorrect Appliance we will replace it immediately. If this is not possible we will make a full refund of the purchase price.

Faulty Goods must be made available for collection within 30 days. Incorrect Goods must be made available for collection within 14 days of receipt. If a refund is to be made the item has to be clearly marked with an RMA (restocking code) which can be obtained by calling our Support number 02380 788155.

In the unusual event that we deliver a faulty or incorrect Appliance we will at your choice replace the faulty Appliance or make a full refund.
